Introduction

This Agreement (the “Agreement”) is made upon scheduling a Demonstration or Activation by and between:

  • Party A: Esphera Operadora de Servicios Turísticos S.A. de C.V., RFC EOS240416Q93, incorporated in Oaxaca, Mexico, as a Variable Capital Stock Company (hereinafter referred to as “Party A”).
  • Party B: Any person with a registered Google, Facebook, or Apple account (hereinafter referred to as “Party B”).

By using this website or scheduling a session, you agree to the following terms and conditions.

1. User Types

A. Direct User

  • Definition: A registered user who purchases their own Activation session or one for someone else.
  • Rights:
    1. Can reschedule once if no vibration is felt in the hands.
    2. Full refund after the second session if no vibration is felt in the hands.
    3. Cannot earn commissions on Yoga Teacher Training.

B. Guest User

  • Definition: A user whose entry is purchased by a Direct User.
  • Rights:
    1. 10% discount using the Representative’s code.
    2. Must register for their own session.
    3. Can reschedule once if no vibration is felt in their hands.
    4. Refunds, if applicable, will be issued to the Direct User who made the purchase.

C. Representative User

  • Definition: A user who has earned at least one commission by recommending someone for Activation.
  • Payment: Must link a PayPal account. Commission payment of $20 is sent after the Guest User’s successful Activation.

D. Ambassador

  • Privilege: Selected selfie used for commercial purposes, awarded 11 free Activations to invite others.
  • Policy: If the guest’s email is mistyped, the invitation is lost.

E. Guest of Ambassador

  • Access: Free access using the Ambassador’s code.
  • Policy: No refunds.

F. Organization User

  • Definition: Users sought out by Sixth Sense to represent the brand in their organization.
  • Privileges: Free Activations provided to three organization members.
  • Flyers: Sent to the address upon verbal acceptance.

G. Celebrity User

  • Definition: Users sought out by Sixth Sense to represent the brand in their organization.
  • Privileges: Free Activations provided to two organization members.

H. Yoga Teacher

  • Definition: An activated user who purchases the Sixth Sense Teacher Training.
  • Privileges: Access to exclusive training videos and tools to enhance their practice.

I. Mobile User

  • Definition: Any user that downloads the mobile application.
  • Privileges: Full access to the mobile application’s functionality, including practice tools and videos.

2. Defined Terms

A. Sixth Sense: A personal practice by Eric Haddad providing free remote Demonstrations and paid remote Activations.

B. Quantum Energy/Harmony: The energy transmitted during Sixth Sense Activation sessions, referred to as "Harmony."

C. Demonstration

  • Scheduling: Users can book in advance from preset times available daily.
  • Policies:
    1. Free energy experience prior to purchasing an Activation.
    2. Reconnection allowed if session is interrupted.
    3. No guarantee of feeling vibrations.
    4. Requires parental permission for users under 18.
    5. Users receive an email confirmation with session details.
    6. Users are invited to record a video about their experience after the session.

D. Activation

  • Scheduling: Book in advance, choosing from preset times daily.
  • Experience: Remote transmission of Quantum Energy to the user’s hands.
  • Policies:
    1. Users can reschedule if no energy is felt.
    2. Full refund after the second session if no energy is felt.
    3. Email confirmation with session details provided.
    4. Requires parental permission for under-18 users.
    5. Record a video post-session about the experience.

E. Channel/Activated

  • Description: A person who is capable of performing, applying, and communicating the Sixth Sense technique.

F. Receiver

  • Definition: The person participating in a Demonstration or Activation session.
  • Policies:
    1. Medication use is the user’s responsibility.
    2. No guarantee of symptom healing.
    3. Must attend the session on time and follow instructions.
    4. Can share videos, photos, and messages about their experience.

G. Representative

  • Definition: A user who recommends others to purchase Activations using a discount code.
  • Rights:
    1. Generates a unique personal code
    2. Earns 25% commission per successful Activation.
    3. Receives promotional materials like flyers and images for advertising. 4. Weekly payments made via PayPal.
    5. Must link a payment account to receive commissions.

3. Services Provided

Sixth Sense offers remote energy services:

  • Free Demonstrations: Allowing users to experience Quantum Energy.
  • Paid Activations: Users receive permanent Quantum Energy (Harmony) activation in their hands.

4. Payment and Refunds

A. Payment Terms: Accepted payment methods include PayPal, MercadoPago, Stripe, debit, and credit cards. Payments are processed at the time of booking the Activation.

B. Refund Policy: A refund is provided after the second session if no vibration is felt, with refunds processed to the original payment method.

5. Health Disclaimer

Sixth Sense services are not intended to replace professional medical advice. Always seek advice from your healthcare provider regarding medical concerns.

6. Limitation of Liability

Sixth Sense does not guarantee results or effectiveness. Users assume responsibility for outcomes following their Quantum Energy Activation.

7. Intellectual Property

All materials, including videos, text, and graphics, are the intellectual property of Sixth Sense. Users may access these materials for personal use only.

8. Termination

Sixth Sense reserves the right to terminate user accounts for violations of these terms. Upon termination, users lose access to services and related data.

9. Governing Law and Dispute Resolution

This Agreement is governed by the laws of Oaxaca, Mexico. Any disputes will be resolved through arbitration in accordance with the American Arbitration Association.
